Terms and Conditions for BOLDMEDIA BRANDING

These Terms and Conditions govern the relationship between BOLDMEDIA BRANDING and its clients for all signage and printing services provided. By engaging our services, you agree to these terms.

1. Definitions

• Client: The individual or entity that places an order for goods or services with BOLDMEDIA BRANDING.
• Goods: All products, including signage and printed materials, supplied by BOLDMEDIA BRANDING.
• Contract: The agreement formed between BOLDMEDIA BRANDING and the Client upon acceptance of an order.

2. Orders and Payment

• Deposit: A deposit of 60% of the total order value is required before work begins. Full payment may be requested for certain projects at the discretion of BOLDMEDIA BRANDING.
• Final Payment: The remaining balance must be settled upon completion of the work, prior to delivery or installation.
• Payment Methods: Payments can be made via bank transfer, credit card, or other agreed methods. Any bank charges related to payments are the responsibility of the Client.

3. Artwork and Specifications

• Artwork Submission: Clients must provide print-ready artwork that complies with our specifications. Any additional design work requested will incur extra charges.
• Approval Process: Clients are responsible for reviewing and approving all proofs before production. Once approved, changes may not be possible without incurring additional costs.

4. Delivery and Installation

• Delivery Times: While we strive to meet agreed delivery dates, these are estimates only. BOLDMEDIA BRANDING is not liable for any delays or losses incurred due to late delivery.
• Installation Responsibility: Installation may require electricity, ladders, scaffolding, or other equipment, which will be at the Client’s expense unless otherwise agreed.

5. Liability and Warranty

• Limitation of Liability: BOLDMEDIA BRANDING’s liability is limited to the value of the invoice for work not completed. We are not liable for any indirect or consequential losses, including loss of revenue.
• Warranty: We warrant our workmanship for a period of 12 months from installation. This warranty does not cover damage caused by misuse or acts of nature.

6. Site Responsibility

• Material on Site: Any materials left on site are the responsibility of the Client. BOLDMEDIA BRANDING will not be liable for any loss or damage to materials left on site.

7. Cancellation and Refunds

• Cancellation Policy: Clients may cancel orders at any time; however, deposits are non-refundable once work has commenced.
• No Refunds Policy: All sales are final; no refunds will be issued under any circumstances except as required by law in cases of major defects in goods or services provided.
• Additional Work Charges: Any additional work requested by the Client that falls outside the original scope will be charged separately at our standard rates.

8. Intellectual Property

• Ownership Rights: All intellectual property rights in designs created by BOLDMEDIA BRANDING remain with us unless otherwise agreed in writing.
• Client’s Responsibility: The Client guarantees that they have the right to use all materials provided for production and indemnifies BOLDMEDIA BRANDING against any claims related to copyright infringement.

9. Governing Law

These Terms and Conditions shall be governed by South African law. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of South African courts.

10. General Provisions

• Severability: If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
• Amendments: BOLDMEDIA BRANDING reserves the right to amend these Terms and Conditions at any time. Clients will be notified of changes prior to future transactions.
